Business Owner (Provisional)

You will need to prove that:

• You have an overall successful business career
• For at least 2 or the 4 fiscal years before application, you (or you and your spouse together) have net assets in a qualifying business of at least A$200,000
• For at least 2 of the 4 fiscal years before application, you had ownership interest in a main business or businesses with an annual turnover of at least A$500,000
• Your (or you and your spouse’s combined) business and personal assets have a net values of at least A$500,000 which are available to be transferred to Australia within 2 years of the grant of the visa
• You (or you and your spouse together) have sufficient personal assets in addition to those above, to settle in Australia
• You are under 45 years of age
• You have vocational English
• You have participated in the business with at least 50% of your time in a management position
• No applicants have had a history of business or investment involvement that is not generally acceptable in Australia
• You have a realistic commitment to establish or participate in business in Australia and maintain a substantial ownership and direct and continuous involvement in the management of that business.
• That there is a need for you to be in Australia to conduct the proposed business activity
• You have signed the declaration of obligations.

State/Territory Sponsored Senior Executive (Provisional)

You will need to prove that:

• You have an overall successful business career
• You have sponsorship from an appropriate regional authority of a State or Territory government. Advantage Migration Australia Pty Ltd will provide assistance and lodge the application for sponsorship
• For 2 of the 4 years before application, you have been in a position in the 3 highest levels of the management structure of a major business. You were responsible for strategic policy development affecting a major and wide range of operations of that major business. (A major business means (other than Government Business Enterprise) the annual turnover is no less than A$10,000,000 in any 2 out of the 4 years before application)
• Your (or you and your spouse’s combined) business and personal assets have a net value of at least A$250,000, able to be transferred to Australia within 2 years after the grant of the visa.
• You (or you and your spouse together) have business and personal assets, in addition to those mentioned above, to settle in Australia
• You are under 55 years of age
• No applicants have had a history of business or investment involvement that is not generally acceptable in Australia
• You have a realistic commitment to establish or participate in business in Australia and maintain a substantial ownership and direct and continuous involvement in the management of that business.
• That there is a need for you to be in Australia to conduct the proposed business activity
• You have signed the declaration of obligations.

You will need to prove that:

• You have an overall successful business career
• For 2 of the 4 years before application, you have been in a position in the 3 highest levels of the management structure of a major business. • You (or you and your spouse together) have business and personal assets, in addition to those mentioned above, to settle in Australia

• No applicants have had a history of business or investment involvement that is not generally acceptable in Australia
• You have notified the appropriate regional authority of a State or Territory of your business history and intentions to develop a business in that State or Territory.
• You have a realistic commitment to establish or participate in business in Australia and maintain a substantial ownership and direct and continuous involvement in the management of that business.
• That there is a need for you to be in Australia to conduct the proposed business activity
• You have signed the declaration of obligations.

State/Territory Sponsored Investor (Provisional)

You need to prove that:

• You have sponsorship from an appropriate regional authority of a State or Territory government. Advantage Migration Australia will provide assistance and lodge the application for sponsorship
• You have a total of at least 3 years experience of direct involvement in managing one or more qualifying businesses or eligible investments
• For at least 1 or the 5 fiscal years prior to application:
- you have had direct involvement in either managing a qualifying business in which you (or you and your spouse together) had an ownership interest of at least 10% of the total value of the business or
- you maintained direct involvement in managing your (or you and your spouse’s combined) eligible investments, the total value of which was at least A$750,000.
• For the 2 fiscal years immediately prior to application, the net value of your (or you and your spouse’s) assets was at least A$1,125,000.
• You have demonstrated a high level of management skill in relation to an eligible investment or qualifying business activity
• You will invest A$750,000 into a Designated Investment when visa is ready to be granted.
• You are under 55 years of age OR you are intending to establish or participate in a business that the State/Territory has said is of exceptional economic benefit to the State/Territory
• No applicants have had a history of business or investment involvement that is not generally acceptable in Australia
• You have a realistic commitment to continue to maintain a business or investment activity in Australia after the designated investment has matured
• You have signed the declaration of obligations.

You need to prove that:

• You have an overall successful record of eligible investment or qualifying business activity
• You have a total of at least 3 years experience of direct involvement in managing one or more qualifying businesses or eligible investments
• For at least 1 or the 5 fiscal years prior to application:
- you have had direct involvement in either managing a qualifying business in which you (or you and your spouse together) had an ownership interest of at least 10% of the total value of the business or
- you maintained direct involvement in managing your (or you and your spouse’s combined) eligible investments, the total value of which was at least A$1,500,000.
• For the 2 fiscal years immediately prior to application, the net value of your (or you and your spouse’s) assets was at least A$2,250,000.

• You will invest A$1,500,000 into a Designated Investment when visa is ready to be granted.
• You are under 45 years of age

• You have notified the appropriate regional authority of State/Territory of your business history and intentions to develop a business in that State/Territory
• You have a realistic commitment to continue to maintain a business or investment activity in Australia after the designated investment has matured
• You have signed the declaration of obligations.

• You have a realistic commitment to establish/participate in a qualifying business in Australia and maintain substantial ownership and direct and continuous involvement in the management of that business
• You sign a declaration of your obligations for this visa.

You need to prove that:

• You have been sponsored by the authority for that State/Territory
• That you are the holder of a Provisional Business Owner, State/Territory sponsored Business Owner, Senior Executive, State/Territory sponsored Senior executive, Investor, State/Territory sponsored Investor, or an Independent Executive visa
• You have had and continue to have an ownership interest in one or more main businesses in Australia for at least 2 years before application
• You have an ABN of each of these businesses and have submitted all Business Activity Statements to the Australian Taxation Office
• Unless exceptional circumstances apply you must satisfy 2 of the following 3:
- For the full 12 months before application your (or you and your spouse’s combined) main business(s) employed at least one full-time (or equivalent) employee who is an Australian Citizen, permanent resident or New Zealand passport holder and may not be a member of your family unit.
- For the full 12 months before application, net value of your (or you and your spouse’s combined) personal and business assets in Australian has been at least A$250,000
- For the full 12 months before application, the net value of your (or you and your spouse’s combined) assets in the main business(s) in Australia is at least A$75,000
• In the 12 months before application, your business(s) together had a turnover of at least A$200,000
• No applicants have had a history of business or investment involvement that is not generally acceptable in Australia
• You have been in Australia, holding one of the qualifying visas for at least one year in the 2 years before applying.

• You are the holder of a State/Territory Investor(provisional) visa

• You have been resident as the holder of the above visa in that State/Territory in which you are sponsored for at least 2 of the 4 years prior to application
• You have a genuine and realistic commitment to continue to maintain a business or investment activity in Australia
• At time of decision, the designated investment made for the Provisional visa, has been held continuously for at least 4 years.
